Abstract

Qawa’id al-fiqhiyyah in Islamic disciplines are systematically formulated legal principles that encompass various jurisprudential provisions within their scope. These maxims serve to assist mujtahids in understanding, responding to, and resolving contemporary legal issues. Initially, these jurisprudential maxims were not structured within a specific period but evolved gradually. Their systematic compilation only took place in later periods, aligned with the dynamics and progress of ijtihad among scholars and the founders of the schools of law (madhahib) in Islamic law. Within the Islamic legal system, these maxims hold a strategic position as a conceptual framework that systematizes the understanding of detailed legal matters. The significance of jurisprudential maxims lies in the efficiency they offer in legal analysis, making the process of ijtihad more time- and energy- efficient. Amidst the complexities of modern life, mastering these maxims has become a crucial instrument for legal experts in the decision-making process. Accordingly, this research is directed at dissecting the concepts, urgency, and historicity of jurisprudential maxims to demonstrate their role in producing Islamic legal products that are innovative, adaptive, and responsive to the dynamics of the times.
